They Won't Run It

A little Stoop preview of the Jet-Steelers AFC Championship game: The Steelers have taken the trap play out of the playbook. Every time the play came in from the sideline, it would confuse Roethlisberger; he thought it meant that his offensive linemen would guard the bathroom door while he took advantage of a passed out co-ed.  To avoid a  potential delay of game while Genital Ben figured out the play, they decided to just not run it.

Kagan The Radical

We have all seen that famous clip of football coach Dennis Green, distraught over his team losing to the Bears, lamenting, "They are who we thought they were!"

We can say the same thing about Lady Kaga, Supreme Court Justice Elena Kagan.  We knew that she was an extreme left-wing radical.  During her confirmation hearing, I believed her claim of being a moderate as much as I believed Liberace when he said he was not married because he could not find the right woman to settle down with.

Anyway, Kaga just recorded her first vote on the Court.  And she is who we thought she was.

What do you think of this legal reasoning: a convicted murderer on death row should not be executed because the drug the state wants to inject him with might not be safe?

Huh?

That's Kaga for you.

A little background on the death row killer:  he was sentenced to death for killing a man after he escaped from prison.  Oh yeah, he was in prison in the first place because he was convicted of second degree murder.

Today we get our first opportunity to look at how our wonderful new Supreme Court Justice Elena Kagan is performing by evaluating her first vote as a Supreme Court Justice, which was in support of the issuance of a stay of the execution of murderer Jeffrey Landrigan. A bit about Landrigan: According to reports, Landrigan was first convicted of the first degree murder by stabbing of his best friend in 1982. While in prison for that murder, Landrigan murdered again by stabbing another inmate 14 times. Then he escaped from prison and murdered for the third time in 1989. During the sentencing hearing for the third murder (and who knows if there are more murders attributable to Landrigan), it was reported that Landrigan made a brief statement saying, "I think if you want to give me the death penalty, just bring it on. I'm ready for it." That does not sound to remourseful for all of the lives he shattered during his murder spree, does it? Twenty-plus prison years later (and untold amounts of taxpayer money wasted on him through police, incarceration, publicly funded defense lawyers), the execution was finally arranged and it is with this background that we now Kagan's vote for a stay.


While a vote for a stay of an execution issued by an Upper West Side-raised liberal judge would not be surprising in of itself, it is the reasoning behind her decision that is most shocking. Her vote in favor of the stay was because she had questions about the "safety" of the drug, sodium thiopental, which was set to be used to execute the convicted murderer. Indeed, the lawyers on behalf of Landrigan apparently were not arguing that there was no evidence to support a conviction, or that there was DNA or something which cleared the serial murderer. In fact, it appears that there is no dispute that Landrigan killed at least three times in cold blood. The lawyers for Landrigan, however, persuaded Kagan to the logic that a stay should issue because the drug was "not safe for its intended use." If you're scratching your head at the idea that anyone, much less a Supreme Court Justice, would agree with the logic that a drug meant to kill could be "unsafe" to the person you are trying to kill, then you realize the craziness of liberal logic. In short, they will think of anything to avoid imposing the death penalty.

Kagan's vote was the minority view and the drug apparently was safe for its intended use: Mr Landrigan reportedly died peacefully by lethal injection.

    

Sotomayor Is Out There

 

The self proclaimed wise one, Justice Sotomayor is a left wing radical judge.  We all know it, and the case below shows it.  She lost this case, but if Obama stays in office, he will continue to pick judges that will remake this country  in ways that should concern us all.

Here are the facts:

A guy is in prison.  He has AIDS.  The prison supplies him all the medication he needs for his illness, courtesy of the taxpayer.  His prison duties include hard labor.  He refuses do perform his duties, and also refuses to take his medicine to protest his assignment.

Once he stops taking his medicine, he says he is too weak to work.  The prison says, fuck you, your illness is caused by your refusal to take your medicine-and get to work.

He sues the prison, claiming that by making him work, they are inflicting cruel and unusual punishment on him-and therefore are violating his 8th Amendment rights.

The courts rightfully dismiss his claim using inescapable logic:  how is the prison be inflicting cruel and unusual punishment when they are providing him with medicine and he refuses to take it?

So his case was dismissed-but the wise one, Sotomayor issued a dissent.

She buys this claim.  She thinks this guy has a case.

Think about that.  And think about how she is going to twist our constitution into a left wing manifesto if she gets enough judges to join her.

On Michael Savage, during the Kagan confirmation hearings, a caller starting talking about Kagan being unattractive. Savage interrupted the caller and said "Let's not comment on her appearance. Although I find it personally grotesque, let's talk about her radical, Marxist policies."

Sam The Man

The NY Times examines the first 5 years of the Roberts Court today, and while I disagree with many of its assertions, this one it gets right:

Though Chief Justice Roberts gets all the attention, Justice Alito may thus be the lasting triumph of the administration of President George W. Bush. He thrust Justice Kennedy to the court’s center and has reshaped the future of American law.

Everybody talks about Roberts-Scalia & Thomas, and rightfully so. These men (especially Scalia & Thomas) will be carved into the Mount Rushmore of conservative Justices. But Sam Alito slips through the cracks, and his excellence is often overlooked and underrated.

He is like James Worthy was with the Lakers. Everyone remembers Magic & Kareem, but Worthy is a Hall of Famer as well-and who knows how much they would have won without him?

Alito replaced Sandra Day O'Connor-and amen to that.

And remember, Alito wasn't even Bush's first choice-he tried to put his version of Elena Kagan on the Court, Harriet Miers-but conservatives rose up and said "get the fuck out of here with Harriet Miers".

Alito for O'Connor is one of the best trades since the pilgrims bought Manhattan from the Indians.

The New Benedict Arlen

South Carolina Senator Lindsey Graham was the only Republican on the Judiciary Committee to vote in favor of Elena Kagan's nomination. Here is his explanation:

But I understood — we lost; President Obama won. The Constitution in my view puts a requirement on me not to replace my judgment for his.”

What a statement. The man says the Constitution does not require him to question Obama's judgment when it comes to Supreme Court nominations? A job with a lifetime appointment, with no means of removal, that makes decisions that affects all of our lives?

And what Obama says goes?

What exactly does "advice and consent" mean?

The woman has never even been a Traffic Court judge.

She exhibited actual animus by throwing the military off campus-at a time when we were fighting two wars.

Graham is as wrong as could be. But if you examine his record--he is an open borders man-- it is no surprise.

He has officially taken Benedict Arlen Specter's place. And what happened to Benedict Arlene should happen to him.

We should allow corporate sponsorships of Senate hearings. For example, for the Lady Kaga confirmation hearing, there should be a voice over stating "Elena Kagan's wardrobe provided by Today's Man."

They Go Gaga Over Kaga

Remember that Chris Farley bit on Saturday Night Live when he would interview celebrities that he idolized? He would fawn all over them. It went like this:

Chris Farley: You remember when you were with the Beatles?
Paul McCartney: Yes.
Chris Farley: That was awesome.

I was reminded of this watching the Senate Democrats questioning Kagan during her/his confirmation hearings.

Schumer: Remember when you kicked the military off campus?
Kagan: Yeah.
Schumer: That was awesome.

Call to Arms

With the Supreme Court deciding today that the right to bear arms is guaranteed by the 2nd Amendment, it reminded me of a great story:

The great G. Gordon Liddy was on Howard Stern a while back. (Howard is tight with Liddy, he even gets to call him "G.") Howard always tries to get Liddy to talk about the types of covert shit he was involved in. Once Howard asked Liddy how many guns he owns. Liddy's modest reply:

"Howard I am a convicted felon. Therefore, I am not allowed to own any firearms. However, Mrs. Liddy owns 40 guns."

Bang Bang

The Supreme Court decided today that the 2nd Amendment guarantees- at the very least- Americans the right to bear arms in their homes. It was a 5-4 decision with the usual four rats dissenting: Stevens/Ginsburg/Sotomayor/Breyer.

But their dissents were for different reasons:

Stevens, said that when he first came on the Court 100 years ago, there were no handguns, so he would limit the 2nd Amendment to the right to own a musket in a log cabin.

Ginsburg said that the 2nd Amendment guarantees Americans the right to fire shots into the air in celebration at gay weddings.

The self-proclaimed wise one, Sotomayor got mixed up a little,- as usual- and said that the right to bear arms means citizens have a fundamental right to wear short-sleeved shirts. (Side note: she is also a huge Chicago Bares fan.)

And Breyer, bless his liberal heart, wanted to show that he is open-minded when it comes to the 2nd Amendment, and agreed with all three of his fellow dissenters, namely, you have the right to wear a short-sleeved shirt at a gay wedding held in a log cabin, and while on the premises, you can fire a musket into the air.

But while Ms. Kagan’s biography may be clear, her judicial philosophy is not. She has never been a judge,..... experts said senators had few clues to her judicial philosophy, a subject that will be ripe for exploration when the hearings begin.

A Victory

From the New York Slimes:

In a case pitting free speech against national security, the Supreme Court on Monday upheld a federal law that makes it a crime to provide “material support” to foreign terrorist organizations, even if the help takes the form of training for peacefully resolving conflicts.

The Court rejected the ACLU's position that since the Times Square Bomber used a solar powered car, the bombs that were in the car should not be admitted into evidence.

Kagan Is Unfit For Service

Senator Sessions today kicked facts on Lady Kaga's disgraceful record of barring military recruiters from the Harvard Campus when she was Dean. It violated the law, and was particularly disgraceful at a time when we were/are fighting two wars. Sessions rightfully points out that while she shut the schoolhouse door to our military, she opened it wide to the Saudi Royal family which donated $20 to Harvard for Islamic studies under Kagan's watch. Now under Islamic law, homosexuality is punishable by death. And Kagan was fine with taking money from sponsors of that law. But our military-she had a moral objection to? "Don't Ask Don't Tell" she finds morally repugnant but taking cash to teach Sharia law is acceptable? The bottom line for Kagan and the rest of the extreme left is they will always find common ground in their distain for the military. Every whacked- out leftist group hates the military. And the "Don't Ask Don't Tell" barring from campus was just a pretext they used to mask the hostility they have for our people in uniform.

Here are some excerpts from Sessions excellent commentary followed by the video:

When Ms. Kagan became Dean in 2003 she inherited a policy of full, equal access for the military. But she reversed that policy in clear, open defiance of federal law.

She kicked the military out of the campus recruitment office as our troops at that very moment risked their lives in two wars overseas.

Some have recently attempted to defend Ms. Kagan’s conduct by arguing that she deigned to speak with student veterans, to discuss whether they would coordinate a sort of second-class system for the recruiters who had been coming on campus.

This all happened after she had defied the law and shut down those official channels of the campus recruiting office.

But the Harvard Student Veterans Association plainly expressed to Ms. Kagan, in a letter to the entire law school, that they lacked the resources to take the place of the campus office now closed to the military.

That letter reads in part:

“Given our tiny membership, meager budget, and lack of any office space, we possess neither the time nor the resources to routinely schedule campus rooms or advertise extensively for outside organizations, as is the norm for most recruiting events.”

But Ms. Kagan was unmoved. Instead of welcoming the military recruiters on campus, she punished them and relegated them to second-class status…

On the Saudi connection at Harvard:
Around the same time Ms. Kagan was campaigning to exclude military recruiters—citing what she saw as the evils of Don’t Ask Don’t Tell—Harvard University accepted $20 million from a member of the Saudi Royal family to establish a center for Islamic Studies in his honor.

A recent Obama State Department report concerning Saudi Arabia and Islamic Shari’a law noted that:

“Under Shari’a as interpreted in [Saudi Arabia] sexual activity between two persons of the same gender is punishable by death or flogging.”

Ms. Kagan was perfectly willing to obstruct the U.S. military—which has liberated countless Muslims from the hate and tyranny of Saddam Hussein and the Taliban.

But it seems she sat on the sidelines as Harvard created an Islamic Studies Center funded by—and dedicated to—foreign leaders presiding over a legal system that violates what would appear to be her position.

Hatch Talks Guns With Elena Kagan

This is from a few weeks ago-but it is still funny. Elena Kagan ("Lady Kaga") visted Senator Hatch who shows her the award he received from the NRA. When looking at the award, Kaga says "It's gorgeous" in that heavy Upper West Side accent of hers. She sounds like a character from "Coffee Talk"- that old Michael Myers skit on Saturday Night Live.

I can see Kagan in Coffee Talk saying "The 2nd Amendment does not give citizens the right to own a handgun or a rifle. Discuss amongst yourselves."

But unfortunately, she probably will give that opinion from the bench.

Pat Buchanan, on the sorry-ass credentials of Sotomayor & Kagan:

Ruth Bader Ginsburg tied for first in her class at Columbia, but neither Obama nominee is academically distinguished. Sotomayor called herself an "affirmative action baby" who, at Princeton, was urged to read children's books in the summer to improve her reading and writing skills. Kagan never served as a judge, never litigated a case before being named solicitor general, never wrote a book or anything else anyone has turned up that manifests real legal scholarship.

From her Princeton thesis on the sad demise of 20th-century socialism, to her tears at the defeat of the radical liberal Senate candidate Elizabeth Holtzman in 1980, to her hostility to the U.S. military on the Harvard campus while dean of the law school, Kagan has revealed herself to be one more Ivy League leftist anxious to use a lifetime seat on the court, winning the plaudits of her peers by imposing her ideology on a nation that has never voted for it.

Spitzer Strikes Out; Lady Kaga Hits Homers

"I did not go out with her, but other guys did,” Eliot Spitzer said of his old Princeton buddy Elena Kagan yesterday, joining other longtime friends of the Supreme Court nominee who are reluctantly stepping forward to quash rumors she's a lesbian.

Spitzer went on to say "I even offered her $10,000 to go out on a 'date' with me and she refused. And back then, there were no money laundering banking laws to avoid, so I took the whole $10,000 out in one shot-from the bank account which was flush with cash from the trust fund set up for me by my rich father."

Don't you hate it when the media leaves out the whole quote?

Don't you love the Obama White House? To squash the rumors that Kagan is not gay, they trot out the ex-governor that was busted for prostitution.

If Jim McGreevy actually dated Kagan, the White House would cover it up, and instead go with the Spitzer story.

She is more qualified to be the Mets batting coach than to sit on the Supreme Court.

From that batting stance, she is more than ready for the softball questions the libs on the Senate Judiciary Committee with toss at her.

I see she bats right-handed. To the libs, that is evidence that she will be a centrist Supreme Court Justice.

Kagan PART 1

There are numerous reasons why Elena Kagan should not be confirmed by the Senate. Here is one:

She is the Solicitor General for the Obama administration. The Solicitor General represents the President in matters before the Supreme Court. That means she advocates on behalf of Obama and tries to persuade the Supreme Court to rule in Obama's favor. From Obama's point of view, how could you do better than appointing someone to the Court who already has a history of advocating on your behalf? Are we really supposed to believe that she will be impartial and make the transition from advocate to neutral judge? This is not a Kagan- specific criticism; every Solicitor General should barred from being appointed to the Court by the same President that named them Solicitor General. It would be like Phil Jackson going from coaching the Lakers to NBA ref. With no job or time in between. Would the NBA let him ref Laker games? Of course not. His time as a Laker coach would create a conflict; people would not perceive him as being neutral. The same goes for Kagan, how can we think she would be neutral on the Supreme Court when she was just advocating on behalf of Obama before that very court?

Career Opportunities

Supreme Court Justice Sonia Sotomayor is making the rounds as a commencement speaker at college graduations. I wonder if she has advised graduates of the great opportunity at the New Haven fire department? You get to serve the public, and there is plenty of room for advancement if you score high on the firefighter exam. She could tell them that New Haven has truly progressed because not so long ago, you could have the highest score on the exam and the city would throw the results out because of your race. And a radical liberal judge signed off on and approved this discriminatory practice. And America is a better place because the Supreme Court overturned that decision made by the radical judge. Somehow, though, I don't think this will make it into her speech.

With their victory last night, the Phoenix Suns took a commanding 3-0 lead in their playoff series against the San Antonio Spurs-which means they have a legitimate shot at winning the NBA championship. And if they do, just think about how awesome that victory parade will be in Mexico City.
